I could see being allowed to patent genomes one creates, though in the field of agriculture the legal precedent is for a different system of ownership entirely (we've been genetically engineering our crops since the Neolithic, i.e. by selective breeding, but new varieties are not owned like patents, the system is a very complex form of common-law usufruct, even in most places that use the Civil Law).
